Pool Enclosure Permit
A Pool Enclosure Permit is required to ensure swimming pools and related water features are properly enclosed to protect public safety, particularly for children.
Pool enclosures help prevent unauthorized access and are regulated under the Town’s Pool Enclosure By‑law and applicable building and safety standards.
When a Pool Enclosure Permit Is Required
A Pool Enclosure Permit is required when installing or altering:
- An outdoor swimming pool
- An in‑ground or above‑ground pool
- A hot tub or spa that is not fully enclosed by a building
- Any structure or barrier that forms part of a pool enclosure
A permit is required before installation or construction begins.
What Is Considered a Pool
For pool enclosure requirements, a pool generally includes:
- Any structure intended for swimming or wading
- Any body of water capable of holding a specified depth of water, whether permanent or temporary
Specific definitions are set out in the Pool Enclosure By‑law.
Pool Enclosure Requirements
Pool enclosures are designed to restrict access to the pool area.
Requirements may include:
- A fence or barrier surrounding the pool
- Minimum height requirements
- Gates that are self‑closing and self‑latching
- Restrictions on openings or climbable features
- Clearances from property lines and buildings
All enclosures must comply with the Town’s Pool Enclosure By‑law and approved permit drawings.
Before You Apply
Before applying for a Pool Enclosure Permit, you may need to:
- Confirm zoning requirements, including setbacks
- Review applicable by‑laws and standards
- Prepare drawings showing the pool and enclosure location
Other approvals may be required depending on the property and project scope.
How to Apply
A Pool Enclosure Permit application typically requires:
- A completed application form
- Applicable permit fees
- A site plan showing the pool, enclosure and gates
- Details of fencing, gates and locking mechanisms
Incomplete applications may delay review and approval.
Permit Review & Approval
Once submitted:
- Applications are reviewed for compliance with safety and by‑law requirements
- Revisions may be requested if changes are required
- The permit is issued once all requirements are satisfied
Work must not begin until the permit is issued.
Inspections
Inspections are required to confirm that the pool enclosure has been installed as approved.
- Inspections must be booked once installation is complete
- The enclosure must be fully in place and operational
- Pools must not be filled or used until approval is granted
Failure to arrange required inspections may result in enforcement action.
After the Permit Is Issued
Once approved:
- The pool enclosure must be maintained in good working order
- Gates and locking mechanisms must remain functional
- Changes to the enclosure require approval
Property owners are responsible for ongoing compliance.
